If i ve pulled somebody over, i might become nervous if i don t charge them with something, then maybe i didn t pull them over for a good enough reason. we re kind of baiting officers into making more arrests for every time they re stopping and contacting someone. there s discretion that officers have that are actually in the interests of justice. so mark, does that jibe with the way having been on the job that you think that s what s driving had data we re seeing? yeah, that would had consistent with what i would id expect from the immediate reaction from police officers, law enforcement, you know, there s an adjustment period that s necessary here, especially when you re talking about police nationwide who are really in the midst of this increase in kind of aggressive enforcement-based policing. so to make this adjustment and to still apply the proper amount of discretion will be challenging. but i suspect that months forward, years forward, there will be the adjustment back down ....

Still treating people in a respectful way. i agree with the commissioner. police officers should be trained. they have to i think stop and frisk, you continue to monitor the training. how are the police doing this in the field? we can go about and make neighborhoods safer, and people want us to make them safer. at the same time, they want us to respect the rights they have. even criminals have rights. everybody s got rights. it s the way in which we go about doing our job, the way we go about investigating, the way we write it up. most of the stops are probably good stops but the cops write them up terribly and don t justify the reasons why. it s a problem. when you look at the reason a police officer says they pulled somebody over, like movement. does that worry you, as somebody who respects the constitution? does it worry you that there is a police officer that that person made a defertive movement ....

Issue defense attorneys have. the causal connection, if you give the tip to somebody, go to this truck stop because a vehicle will be there at 2:00 in the afternoon and the vehicle is filled with drugs, but you can t communicate that tip, then you have to find another reason to pull somebody over, legitimate or not legitimate, you have to form that reason. you pull them over, you get the drugs, it forms the basis of the arrest. that s the core issue here, i think, and this is only used for international drug cases and money laundering cases at this point. high, high profile cases. and makes me mad only because it is a tip, it is not evidence. it is a tip. i completely get where you are coming from. it is a little thing called our constitution. very important little thing. jean casarez, you re awesome. thank you. thank you. it is never a good idea to lie to the police. you know that. wait until you hear what one woman said when she was caught speeding and how that was a domino eff ....

Understanding it. so then the question is, why not simplify it? a lot of lawyers would be out of work. well, and i that s a simple answer, right? i mean, paul, do you agree with that? you know, here s the problem. the problem with it is that manslaughter is something that covers an awful lot of situations. let me give you a couple of examples. if you re out drinking too much, and you run a red light and you run somebody over, manslaughter. in this situation, the prosecution is saying manslaughter. if you were to throw a brick off of a building, not intending to hit somebody, but it did hit somebody, manslaughter. all right. so there are all of these different situations that the statute has to cover. all of this very human behavior. so the legislature has to struggle with it and make it big enough that it covers all these categories. but when you have a specific ....
