The U.S. Department of Commerce’s Bureau of Industry and Security (“BIS”) issued final rules amending the Export Administration Regulations (“EAR”) by implementing new export controls on Burma (Myanmar), and adding four entities linked to the recent coup to the Entity List. These final rules effective March 8, 2021 come less than a month after President Biden imposed sanctions blocking U.S. property and interests of Burmese military and government officials.
Burma Removed from Country Group B with Significant Repercussions

U.S. officials have continued to use a range of policy tools to apply pressure on the military leadership of Myanmar (also known as Burma) in response to the military coup in the country and escalating violence against peaceful protestors. These moves have continued to follow a step-by-step approach, with important export control and sanctions additions thus far in March 2021.
New Export Controls
On March 4, 2021, the U.S. Commerce Department’s Bureau of Industry and Security (BIS) announced new export controls and Entity List additions for Myanmar.
First, BIS added Myanmar to the “military end user” and “military end use” restrictions under 15 CFR 744.21, which were previously in place for China, Russia, and Venezuela. This imposes a license requirement for exports, reexports, or transfers of items listed in Supplement No. 2 to Part 744 of the Export Administration Regulations (EAR) where there ....

Summary
Building on the export controls and sanctions measures already imposed by the U.S. government in February in response to the military coup in Burma, the Bureau of Industry and Security (“BIS”) imposed additional export control restrictions on March 8, 2021, and OFAC designated additional parties as Specially Designated Nationals and Blocked Persons (“SDN”).
The final rule published by BIS on March 8, 2021 implements the following changes to the Export Administration Regulations (“EAR”) affecting Burma:
