ROBERT BUCKLAND: Award scheme recognises those who have stepped up during pandemic

Here in Swindon, we have many brilliant local organisations and businesses who have worked extremely hard throughout the pandemic, often in extremely difficult circumstances, often going above and beyond to support our local community.
I am glad that our Government has stepped in to help throughout the pandemic, supporting those organisations by providing a range of packages worth around £82 million through grants and business rate reliefs for example.
I am also pleased that the Government has announced a new award scheme to celebrate those who have been playing a leading role in communities across the country. The Levelling Up Goals Awards recognise those people and organisations that are committed to boosting opportunity and helping to level up the UK in the wake of Covid-19. ....

Credit for Guilty Plea
The issue of how much credit a defendant can legitimately expect for a guilty plea continues to receive attention from the courts.

In R v Bannergee [2020] EWCA Crim 909, the Court of Appeal held that if a defence advocate indicated a ‘likely guilty plea’ on a Better Case Management form in respect of a case destined for the Crown court, this would not necessarily result in full credit being given when that guilty plea was eventually entered. This was reiterated in R v Hodgin [2020] EWCA Crim 1388. The defence may not receive much more than a case summary at the magistrates’ court and may be loath to advise an unequivocal guilty plea. Paragraph F1 of the Sentencing Council’s guideline for reduction on guilty pleas does provide that full credit may be retained if particular circumstances significantly reduced the defendant’s ability to understand what is alleged or made it unreasonable to expect him to indicate a plea sooner ....

The Sentencing Academy, an expert group which examines sentencing in England and Wales, has published new report, Sentence Reductions for Guilty Pleas: A review of policy, practice and research. This new report was authored by by Jay Gormley, Julian V. Roberts, Jonathan Bild and Lyndon Harris, and here is part of its executive summary:
Most convictions in England and Wales in the Crown Court and the magistrates’ courts arise as a result of the defendant entering a guilty plea.  Courts are explicitly required to consider the guilty plea when passing sentence by section 73 of the Sentencing Code (previously section 144 of the Criminal Justice Act 2003).  Defendants who plead guilty and who waive their right to a trial are normally entitled to a sentence reduction.  All common law jurisdictions offer sentence reductions to defendants who forgo their right to trial and instead plead guilty. ....

They tell you a little bit of the evidence. they tell the attorneys what the plea offer is going to be. if you don t accept it they go to the grand jury. what the feds do i can tell you this as a defense attorney practicing in this area you must plead to the highest most readily provable offense. every time they go into the grand jury and ratchet up the charges she is looking at greater exposure and not accepting the responsibility doesn t give her the coveted reductions in the sentencing code like felicity huffman got for a lighter sentence. to quote the great mr. t, the more you wait, pain. bill: did mr. t say that? sounds to me like they re trying to squeeze her. there has been that rumor. what they re doing is giving her a break. we have this memo that says if we go in and get higher charges you have to plead guilty to the hire charge. we re giving you opportunities each step of the way to plead guilty to the lesser charges. ....
