Singapore Court of Appeal Affirms the Importance of Pleadings in Arbitration Proceedings – Publications

The latest case of PhoenixFin Pte Ltd. and others v. Convexity Ltd. is the culmination of a series of Court of Appeal of Singapore cases setting out the significance of pleadings in arbitration. The court held that pleadings in arbitration are important especially when an issue is of mixed fact and law and can be the basis for a finding of breach of natural justice warranting the setting aside of the arbitral award. This is notwithstanding the common belief that there is an amount of flexibility in the approach to pleadings in arbitration such that pleadings may take the back seat in arbitration proceedings. ....

Ketiga:
Tidak seperti hari-hari yang lain, pada awal bulan Dzulhijjah Allah Ta’ala kumpulkan semua bentuk ibadah di dalamnya. Shalat, zakat mal bagi yang sudah mencapai nishab dan haul, puasa bagi siapa saja yang ingin menambahkan amalan sunnahnya atau jamaah haji yang wajib membayar dam (denda) atau al-hadyu tapi tidak memperoleh hewan sesembelihan. Di hari-hari itu Allah Ta’ala juga memerintahkan syariat haji, talbiah dan doa. Semua itu menujukkan keagungan awal bulan Dzulhijjah.
Keempat
Pada bulan ini terdapat juga hari Arafah, yaitu hari ke-sembilan bulan Dzulhijjah. Hari Arafah ini adalah hari pengampunan dosa dan dibebaskan dari neraka. Rasulullah shallallahu alaihi wa sallam bersabda,“Tidak ada hari yang Allah lebih banyak membebaskan hambaNya dari neraka selain hari Arafah. Sesungguhnya (pada hari itu) Allah mendekat dan membanggakan mereka kepada para malaikat, seraya berfirman, ‘Apa yang diinginkan mereka.” (HR. Muslim, no. 1348) ....
