Identity was known to prosecutors but they lied to the jury saying victim two was only known only to god f it is true it is prosectorial misconduct and could lead to sandusky being released from prison. But Deputy Attorney jen fur peterson says that the state was unsure whether allen myers was indeed victim number two. And that is why he was never identified as such, in 2012. Contradictory information, that he had presented over the course of the investigation, certainly gave the prosecution some doubt as to whether he was number two. That is he was a victim in general. Reporter now even though the judge scheduled only three days for this hearing, i did speak with al lindsey, sanduskys current defense attorney and says there will not be a decision made tomorrow and is there no word when that decision will be made as to where on the sandusky could face a new trial or be released from prison.
