校方的性別平等教育委員會組成調查小組，詢問女學生等人及檢視曾男陳述意見後，認定曾男行為構成性騷擾且情節重大，建議依教師法規定予以解聘。
曾男主張，校方處分應有解聘、停聘或不續聘等，本件性騷擾行為情節是否重大，校方並未充分進行調查，僅依學生單方指述，就施以最嚴厲的解聘手段，使他終身不得任教，影響其工作權，明顯違反比例原則，且校方有裁量濫用之嫌，請求撤銷原處分。
校方抗辯表示，性平會有充分調查，有給曾男2次陳述意見的機會，曾男也有提交陳述意見書；曾男所涉性騷擾事件有多人受害，情節重大，且是在曾男權力優勢下受害，解聘處分並無違誤。
法院調查後認定，曾男蓄意利用教師身分及權勢製造機會，從事嚴重侵犯學生人格自主尊嚴� ....
