It is no longer a random act Facebook censorship has become so blatant and massive that they have indefinitely silenced the former president of the United States. Many pro-censorship advocates cheer this on because they dislike the voices silenced by Facebook. They attempt to justify the censorship with the claims that Facebook is a private company and can do what they want, a lawsuit filed against the social media giant says that is not the case.

Back in January, we wrote about a bizarrely bad Wall Street Journal op-ed co-written by disgraced and suspended Yale Law professor Jed Rubenfeld, arguing that Section 230 somehow magically makes social media companies state actors, controlled by the 1st Amendment. This is, to put it mildly, wrong. His argument is convoluted and not at all convincing. He takes the
correct idea that government officials threatening private companies with government retaliation if they do not remove speech creates 1st Amendment issues, and then tries to extend it by saying that because 230 gives companies more freedom to remove content, that magically makes them state actors. ....

Lawsuit Claims Feds Directed Facebook to Censor Vaccine Misinformation

SAN FRANCISCO (CN) In a lawsuit claiming Facebook conspired with the federal government to squelch an anti-vaccine group’s speech, a federal judge on Wednesday questioned whether the state can work with private companies to combat misinformation without violating the First Amendment.
Senior U.S. District Judge Susan Illston oversees a lawsuit brought by Children’s Health Defense (CHD), a Georgia nonprofit founded by vaccine skeptic Robert F. Kennedy Jr. The group publishes information about supposed harms associated with vaccines and 5G wireless networks, which critics have denounced as conspiracy theories and misinformation.
In January 2019, Facebook started slapping warning labels on content posted on CHD’s Facebook page, including in September that year when the social media giant posted a message directing users to seek “reliable, up-to-date information” about vaccines from the U.S. Centers for Disease Control and Prevention. ....
