Illinois Biometric Information Privacy Act BIPA class action lawsuits were heavily litigated again in 2022, as plaintiffs continued to target companies using biometric technology. At the same time, avoiding liability continued to be challenge for businesses defending BIPA case.
Moledina v. Marriott Int’l, Inc. C.D. Cal. Oct. 17, 2022, Plaintiff accused Marriott of recording customer phone calls without proper disclosure, violation of California Invasion of Privacy Act. Marriott filed motion on pleadings arguing lack of personal jurisdiction.
Colorado Attorney General’s Office submitted an initial draft of the Colorado Privacy Act Rules CPA Rules, which will implement enforce Colorado Privacy Act CPA. The CPA Rules, which are currently about 38 pages, address many recent issues in state data privacy regulation.
Governor Gavin Newsom signed into law AB-984 and becomes effective January 1 2023 builds on privacy protections California Consumer Privacy Act and Penal Code Sec. 637.7. Section 637.7 prohibits using electronic tracking device to determine the location or movement of a person.
