The construction union has won a key battle against a wave of non-union agreements in NSW, convincing the workplace tribunal to reject a deal because the employerâs two-hour meeting and page-by-page explanation to workers was not sufficient to satisfy the Fair Work Act.
The Fair Work Commissionâs rejection of second-tier builder Lipmanâs agreement, which would have covered major regional projects, could threaten the approval of four other non-union agreements on similar grounds, but employers have complained that the âhigh barâ is not being applied to union deals.

A Labor-aligned think tank with a history of forecasting the party’s policy is urging all workers to be given paid holidays and sick leave even if they are independent contractors or casuals.
