MSNBC Way Too Early With Jonathan Lemire June 4, 2024 10:06:00

He killed his wife and son because he was trying to parlay that into sympathy and avoid prosecution for his fraud crimes. interestingly enough, that is the one thing that almost got them an acquittal. i think that was a mistake by the state in an otherwise powerful case that they had to introduce that mode of evidence, and i think the state in a way conseed that in the rebuttal argument and moved away from that and said, listen, we don t need motive. motive is not an element of a crime, we provide motive so you can have a better understanding of the case. if you conclude this defendant was out of his mind that s enough. you don t need a specific motive. that s a great point about the motive, but clearly the jury didn t need it. sentencing later today. thank you so much for joining us and we ll see you again in a little bit on morning joe. meanwhile the annual conservative conference, cpac, kicked off in maryland with a much different look than usual. ....

Arguments from both the prosecution and the defense and the rebuttal argument from the prosecution. the prosecutors going after jussie smollett not just saying his words on the stand were inconsistent, but saying that he was a liar. here s how prosecutor webb put it. he said that in january 2019, mr. smollett developed a secret plan to carry out a fake hate crime. he falsely reported it and i told you that is a crime. mr. smollett failed to tell the truth and made many false statements. he lied under oath to you jurors. he lacks any credibility whatsoever. he was tailoring his testimony. as you know, there were two men who took the stand who were very important witnesses in this case. and that was the osundaiaro brothers. both of them testifying they indeed were paid by jussie smollett to carry out this fake hate crime against him in order for him to get more media attention. that that s what they said on the stand. smollett s attorney went after ....

This morning. we know that they started sharp around 8:30 this morning. and that they will deliberate until they reach a verdict. it sounded as if they were going towards that, they did not give any indication that they were hung or that they were having trouble coming up with a decision. that s what we heard from the foreperson yesterday. and as you know, they listened to closing arguments on monday. and then as in every trial, the prosecution gets the last word, the prosecution gets to rebutt, have a rebuttal argument, to sum up their case, and those are the last words that the jury hears, but as you know, it is not about the closing arguments, those help the jury understand from each side where they re coming from, but they have to look at the evidence. in this case, there are nine charges for each of the three defendants including murder and aggravated assault. and so you ll have this jury looking through a lot of information, ultimately the arguments go like this, the prosecution ....

reporter: that s right. we heard from the judge. the judge basically called the jury in last night around 6:00 and asked them if they were close to a verdict and here s where there is a bit of a clue because we heard for first time from the foreperson who said that we are in the process of working to reach a verdict. and at first they didn t want to go home. so it gives you some sense of where they are, in that it is possible that we will see a verdict today or this week. but we have been watching this trial for now 14 days. and now deliberations into the second day, they re starting bright and early and about 25 minutes, the jury will start their deliberations again. and we heard a lot of different arguments. we heard from the prosecution, though, which gets the last word in every case, they get a rebuttal argument to the closing arguments by themselves and the defense. and what we heard from the prosecution was a story of what happened to ahmaud arbery, we heard the prosecution tal ....
