要反家暴，首先要明确家庭暴力是什么。条例草案对家暴涵盖范围较广，明确为“家庭成员之间实施的身体暴力、性暴力、精神暴力、经济控制等侵害行为”，并列举了7种具体行为，还专门强调利用网络等手段实施这7种侵害行为的也属于家庭暴力。
在司法实践中，一些暴力行为发生在诸如同居双方、离婚后的双方之间。对具有或曾有亲密关系，但又没有血缘关系的双方间的暴力行为如何处理，中外观点不一。本次立法拟明确，家庭成员以外具有监护、扶养、寄养、非婚同居等关系的共同生活的人之间实施的暴力行为，参照本条例规定执行。曾有配偶、同居关系的人之间，加害人实施本条例规定的暴力行为的，也参照本条例规定执行。
另外，本次立法一大亮点是明确了目睹或者耳闻家庭暴力的未成年 ....
