Certain migrants into the u.s. with no way to track them. how has that impacted processing and what are you hearing now from dhs? yeah, that s right. i mean, they say they will comply, but we understand they re keeping all their legal options open. this is a florida judge who said they cannot go forward with a plan to release migrants without court dates or without the ability to track them. that was under a plan to send migrants to an i.c.e. office to get their court date there within 60 days of their release. it was a process they had in place when they got to those points of over capacity that i talked about. but secretary of homeland security alejandro mayorkas was just speaking to savannah guthrie on the today show when she asked him if the border was secure. here s what he had to say. you say the border is not open, but there is a subset of people who are being released into this country with no court date and no way to track them. that sounds like the border is open for so ....

People arriving after title 42 was lifted. what we ve seen, chris, is the same numbers day after day, so it is slowly growing, but also border patrol is slowly taking in some of these migrants for processing. we also know that the shelters in san diego are almost at capacity. these are the shelters that we see the asylum seekers that have been granted permission to remain in the u.s. while they continue through that process. and it s important to keep in mind, chris, that under the new immigration policy, vhs secretary mayorkas said individuals who arrive at the border or arrive in the u.s. not using a legal pathway will not be eligible for asylum, so under that policy now that title 42 has been lifted, all of the individuals that we have in places like this camp and in texas and other parts of the u.s./mexico border would be ineligible for asylum if they re changing things or the way they process these migrants this morning now that title 42 has been lifted, chris. ....

American immigration policy as well, obscure as it has been what is different about this one? that s a great question. normally, under title 8 processing, someone comes to the border to port of entry or enter between ports of entry and request asylum. they are given what is called a credible fear interview where their claims are assessed for their likelihood of later being able to gain asylum. and that is the way the process has worked for decades. but what the biden administration is doing here is saying, if you enter between a port of entry or if you don t get an appointment in advance, one of a limited number of appointments in advance to come to the official border crossing, you ll be barred from asylum. what that does, it puts asylum seekers in an impossible situation because they are in dangerous conditions in northern mexico where many of them have been extorted, raped, kidnapped, ....
