Thursday, June 3, 2021 Even as Governors lift mask mandates and sporting events welcome fans to stadiums, some states are revisiting their price gouging laws. Recently, several states have advanced legislation to amend or create price gouging statutes. State governments are learning from experiences during COVID-19 emergencies and some are proposing legislation to adjust the scope, definitions, and penalties for price gouging. Nevada Nevada does not currently have a price gouging statute. At the outset of the COVID-19 pandemic, the Governor issued an executive order directing law enforcement to “monitor and investigate” various business practices including coordinated pricing, fraud, or coercion. EO 2020-03-12, § 5. But, the state of emergency did not trigger specific pricing restrictions. ....
After the Colonial Pipeline shutdown prompted Governor Brian Kemp to declare a state of emergency in Georgia, he suspended the tax on gas and invoked the price gouging statute. ....
By Mark Robertson Governor Kemp Today Governor Brian P. Kemp signed an executive order to temporarily suspend the gas tax in Georgia in light of the Colonial Pipeline cyber attack. The Governor also announced that Georgia is increasing the weight limits for trucks transporting fuel, providing more supply for stations as they receive deliveries. The order further prohibits price gouging by bad actors looking to exploit the situation. “My office has been in close contact with company and industry officials since we first learned of the Colonial cyber attack over the weekend, said Governor Kemp. Unfortunately, extensive media coverage has caused people to panic which has resulted in higher gas prices. We are taking action to relieve some of the cost burden from Georgians as Colonial recovers by suspending fuel taxes, increasing the weight limit for supply trucks, and prohibiting price gouging. ....
Wednesday, March 3, 2021 As Texas and other southern states thaw from a frigid winter storm, companies doing business in these states should assess and take steps to minimize the risk of a price gouging claims. As suits are filed in the wake of the storms, companies should prepare now to defend such claims, whether from state attorneys general or from private plaintiffs. In road-mapping a defense strategy, the following information may be helpful. Covered Products Only certain products are covered by price gouging laws and these laws vary by state. It is important to identify whether products are being sold in states hit by the winter storm. For example, the Governors of Texas and Oklahoma declared states of emergency in the wake of the February winter storm, and the laws in those states cover different products.
