Nine. nicole? reporter: throughout the recordings nicole has trouble concentrating. at one point she clearly can t pick out a suspect photo. did one of those people put fire on your mommy? unh-unh. you don t see one of them? look at them close. no. none of them did. reporter: when an appeals court looked at the new evidence, they ruled that mark soderstein deserved another trial. he believed sooner or later justice would prevail and he d get out. reporter: it may have prevailed but he never made it out of prison. eight months before he won his appeal, he died of a heart attack at the age of 48. he had spent more than 20 years of his life in prison. the court of appeals was extremely critical of prosecutors for not turning over the tapes. philip cline was reported to the state bar for prosecutorial ....
