Judge won’t order Montclair teachers to return to in-person instruction in ongoing lawsuit

Public school students in Montclair school district will not set foot in a classroom until at least March after a judge denied the board of education’s request for a temporary injunction that would have immediately ordered teachers back in the classroom during the coronavirus pandemic.
Judge James Paganelli wrote that the Montclair Board of Education failed to prove that the district’s approximately 6,700 students have suffered “irreparable harm” by receiving remote instruction. The judge went on to say that the district hasn’t proven it has fully complied with the state department of education’s required health and safety standards to reopen schools.

Students didn’t return to elementary schools in Montclair, N.J., as planned after a tense week of debate and a boycott of prep sessions by some educators.

After several false starts over the last two months, public schools in Montclair, N.J., an affluent New York City suburb, were finally set to reopen Monday for the first time since the pandemic shut them down in March.

Will Montclair Public Schools open for in-person learning on Monday with teachers in the building? That remains uncertain. What is clear, after a more than four hour Montclair Board of Education meeting, is just how strained the relationship is between the Montclair Education Association and Montclair Public Schools Superintendent Dr. Jonathan Ponds.
CBS News reported on the conflict over whether to return to in-person learning, speaking with MEA President Petal Robertson as well as parents. Ponds reiterated his stance, both to CBS, and to parents on Wednesday’s BOE call, that it is his plan to open schools for in-person learning on Monday, January 25 for students in kindergarten through 5th grade.
