SCOTUS Texas v. New Mexico Water Delivery Case Decision

On December 14, 2020, the U.S. Supreme Court decided 
Texas v. New Mexico, holding that New Mexico was entitled to delivery credit under the Pecos River Compact for water stored at the request of Texas that evaporated during storage.
The Pecos River originates in New Mexico and flows south through Texas into the Rio Grande River. Texas and New Mexico are parties to the Pecos River Compact, which provides for “the equitable division and apportionment of the use of the waters of the Pecos River” between the two states. In 1987, after several disputes under the Compact, the Supreme Court appointed a “River Master” to calculate New Mexico’s annual delivery obligation to Texas. ....

SCOTUS sides with New Mexico in water war with Texas

New Mexico should not be responsible for Pecos River water intended for Texas that evaporated while New Mexico held it in a reservoir to prevent flooding following a tropical storm, the U.S. Supreme Court said on Monday.
In an 8-0 ruling, the court rejected Texas’ bid to be compensated under the states’ Pecos River Compact for some of the 21,000 acre-feet of the river’s water that farmers and ranchers depend on to irrigate their land, finding invalid Texas’ argument that the water lost to evaporation was actually not intended for the state’s benefit.

Texas Loses Original Jurisdiction Case at Supreme Court

The Pecos River merges with the Rio Grande (L), at the U.S.-Mexico border on October 16, 2016 near Landry, West Texas. The Rio Grande, which forms the Texas-Mexico border, is supplemented by various rivers along its course before flowing into the Gulf of Mexico.
The U.S. Supreme Court on Monday ruled against Texas in a dispute with New Mexico over water rights. The case and decision present a somewhat uncommon instance of the court’s original jurisdiction.
Writing for a 7-1 majority, Justice
Brett Kavanaugh denied a motion by the Lone Star State to review a 2015 determination by the Pecos River Master. The master previously determined that New Mexico was entitled to a credit for lost rainwater after Texas asked for the water to be stored in a federal reservoir for use during drought season–which resulted in a massive depletion of the resource. ....
