Class action alleges Nationstar violated state Consumer Credit and Protection Act

Karolina Grabowska/Pexels WHEELING A woman filed a class action against NationStar Mortgage alleging West Virginia Consumer Credit and Protection Act (CCPA) violations. Maureen Vannest claims Nationstar charges a pay-to-pay fee between $14 and $19 each time a customer makes a payment over the phone, constantly violating West Virginia s CCPA, according to a complaint filed in Ohio Circuit Court. Despite its uniform contractual obligations to charge only fees explicitly allowed under the mortgage, applicable law, and only those amounts actually disbursed, Nationstar leverages its position of power over homeowners and demands exorbitant Pay-to-Pay Fees, the complaint states. Vannest is seeking compensatory damages with pre- and post-judgment interest, as well as civil penalties. She is represented by Jason E. Causey of Bordas & Bordas and Jonathan R. Marshall and Patricia Kipnis of Bailey & Glasser.
