Brindisi Tenney NY22: Judge hears affidavit ballot arguments

The final undecided Congressional race in the country was back in court for oral arguments on the fate of unprocessed online voter registration applications from Oneida County on Friday.  Attorneys for Democrat Anthony Brindisi and Republican Claudia Tenney defended points made in legal briefs filed Thursday in a virtual Oswego County Supreme Court. The 69 affidavit ballots challenged by the Brindisi campaign were connected to more than 2,400 online voter registration forms submitted by the state’s Oct. 9 deadline but not processed by Election Day.  Tenney, of New Hartford, leads Brindisi, of Utica, by 29 votes in the race for New York’s 22nd Congressional District.

The nation’s last undecided congressional race remains in judicial review in Oswego County Supreme Court.   Incumbent Anthony Brindisi, a Utica Democrat, trails Republican Claudia Tenney by 29 votes in current tallies, which have not been certified. Tenney, of New Hartford, was unseated by Brindisi by less than 4,500 votes in 2018.  How we got here Tenney held a 28,422 vote lead on Election Day returns, but the gap closed for Brindisi as absentee and affidavit ballots were counted. The judicial review lawsuit, filed by Tenney on Nov. 4, held its first hearing to review ballots on Nov. 23 after the preliminary count was complete in the district.
