Supreme court will do on the second one, the health requirement that would cover about 17 million workers. the court may be more willing to allow that one to go into effect nationwide. it s blocked in about half the states now. and there s a big difference here. there s an entirely different regime of statutes. justice elena kagan said today, certainly the one thing hhs can say to people who employ health care workers is, you re not allowed to kill your patients. and there is also a strange legal aspect to this. the people that are suing in the osha cases are the employers who would have to do this. the people that are suing in the hhs cases are primarily not hospitals and nursing homes, they re states and other groups that are opposed to it. so there s a legal complication there. so my guess here is that the court will say they can t enforce the osha requirement but they can enforce the hhs requirement. it s less clear about hhs. it s pretty clear about osha. ....

He s a good barometer on where the court is headed on this one. it was quite a dramatic morning at the court. went for nearly four hours, jake, for the first time the justices themselves were wearing masks. that hadn t happened during oral arguments before and between covid in the snow, only about eight reporters in the room with law clerks and others. so a lot of tension. a lot of drama and i think what we heard and we ll know when they eventually rule is that they are not interested in upholding what the osha requirement that would be on some 80 million workers. private businesses to either have vaccinations or testing. chief justice roberts, to your question, talked about congressional power over agency power and state police powers. his message seemed to be that osha had gone too far. at one point he said we ve never had anything like this. and the biden administration lawyer said, well, you know, federal law allows osha to go ....

Arguments, cases are done, they rest in the hands of the justices as we stand by. so about that first one. that is the osha requirement. it s the employer that has 100 or more employees. you got to request you got to have a mandate for a vaccine or you can request masking and testing if you re unvaccinated. it was clear all of the liberal justices saw there wasn t even a question of the mandate and not to put a stay on it. here s justin kagan. more and more people are dying every day, more and more people are getting sick every day. i don t mean to be dramatic here. i m stating facts. this is the policy that is most geared to stopping all of this. there s nothing else that will perform that function better than incentivizing people strongly to vaccinate ....

As i ve long advocated, we need mandates. the president proposed this osha requirement that employers with over 100 employees get their workers vaccinated. you see cms proposing that all health care workers get vaccinated. that s really the way we re going to do it. we don t get 85, 95% of children vaccinated against things like measles, diphtheria, tetanus by voluntary action. we get it by mandates, this is what you have to do to go to school. the problem is, as margaret points out, this has become political, cultural, simply a way to win votes of a diehard base for primaries. that is when it gets politicized, that s when science takes a back seat and all sorts of misinformation happens. this isn t the first time we ve had misinformation in american politics. it won t be the last. what we do have that makes a difference is, as margaret points out, twitter, facebook, ....
