Tuesday’s ruling, which affirmed a Bergen County Superior Court decision in September, means that candidates for Village Council and the Board of Education will now be on the ballot with partisan contests in the fall.
RIDGEWOOD An appellate judge has sided with residents who sought to move the election dates for the Village Council and Board of Education to November.
Judge Richard Geiger on Tuesday affirmed a September ruling by Superior Court Judge Estela De La Cruz that Village Clerk Heather Mailander had acted improperly and unlawfully in attempting to block a petition by the group One Village One Vote to place the question of fall elections for both bodies on the November ballot.
In scathing language echoing the De La Cruz decision, Geiger said Mailander s arguments go far afield of her ministerial role as municipal clerk and that she had punted her ministerial obligation to notify plaintiff of the reasons for her rejection of the Aug. 13 petition.
