RTC acquits 2 Aetas of terrorism charges

Published July 19, 2021, 2:23 PM Regional Trial Court (RTC) Two Aeta tribesmen who were arrested in Aug. 2020 by the military have been acquitted by the Olongapo City regional trial court (RTC) of illegal possession of firearms and explosives, and violation of the Anti-Terrorism Act (ATA) of 2020. RTC Judge Melani Fay V. Tadili granted the demurrer to evidence filed by Japer T. Gurong and Junior U. Ramos in an order issued last July 15. “WHEREFORE, the Demurrer to Evidence is GRANTED. These cases are ordered DISMISSED on the ground of insufficiency of evidence,” Judge Tadili ruled. A demurrer to evidence is filed by an accused in a criminal case to dismiss the charges on allegation of weakness of the evidence presented by the prosecution.

AFP's Arevalo: Military not into torturing, detaining civilians

By ANNA FELICIA BAJO, GMA News Published February 4, 2021 8:51am Updated February 4, 2021 9:23am The Armed Forces of the Philippines (AFP) on Thursday denied that it is the practice of the military to torture civilians, insisting that troops respect human rights in accordance to their mandate. The act that our soldiers are accused of is a serious allegation that is neither a policy nor a practice. As a matter of fact, AFP regulations mandate that we respect human rights and abide by the law of armed conflict, AFP spokesman Major General Edgard Arevalo said in a message to GMA News Online. Deinla had said two Aetas were supposedly tortured by government forces as a form of reprisal for the death of a soldier during an encounter with rebels in Zambales in August 2020.

endIndex: Metro Manila (CNN Philippines, February 2) Two Aetas who claim to be tortured by the military and falsely charged with violating the Anti-Terrorism Act have asked the Supreme Court to allow them to intervene in the petitions seeking to junk the “void and unconstitutional law.” Japer Gurung and Junior Ramos have been detained since August as the military accused them of being among the members of the New People’s Army who fired at a group of soldiers in Barangay Buhawen, San Marcelino, Zambales, resulting in the death of Sgt. Rudil Dilao. Gurung and Ramos, through their lawyers, filed a 42-page petition against the anti-terrorism law on Jan. 30. This was made public on Tuesday the day the Supreme Court holds oral arguments on the highly-contested law.
