Michigan Department of Corrections sued over removing hijabs for mugshots - JURIST - News

The Council on American-Islamic Relations, Michigan chapter (CAIR-MI) filed a lawsuit Monday against the Michigan Department of Corrections (MDOC) for making Muslim and Moorish Science women remove their hijabs for mugshots.
Photographs of the women without their hijabs are posted on MDOC’s public website. DOC ID cards also display the mugshots. The “Muslim and Moorish Science women who observe the hijab must wear it at all times while in public or in the presence of men to whom they are not closely related.”
The plaintiffs allege violations of the First Amendment, Religious Land Use and Institutionalized Persons Act and the Michigan Constitution. It is argued that there is no legitimate government interest in publishing these photographs against the women’s religious interests. ....

CAIR-MI sues MDOC in federal court over hijab photo policy

The Michigan chapter of the Council on American-Islamic Relations (CAIR-MI), a Muslim civil rights and advocacy organization, filed a lawsuit Monday against the Michigan Department of Corrections (MDOC) in the U.S. District Court for the Eastern District of Michigan.
The lawsuit was brought on behalf of Muslim and Moorish Science women who are being housed primarily at the MDOC s Women s Huron Valley Correctional Facility in Pittsfield Township.
According to the complaint, the MDOC has a policy that forces female inmates to remove their religious head scarves, known as hijabs, to have an ID photo taken.The MDOC then places the photo on the women s identification cards which the women are requird to present to male and female guards and staff. ....
