There s 30 counts that the defendant is facing in this case. and 17 of those carry the death penalty. and so the defense even in moving forward in this case has not contested the issue of real guilt. they have said he was there, he was a participant. the real issue is whether or not his brother manipulated him. we need to understand that the judge limited in large measure the defense s ability to go in very much in terms of the brother because that s not a defense. it may be what we call a mitigating or lessening factor to place in context why he did what he did. but it certainly does not justify it. now, in terms of the verdict, once that verdict is read and we certainly expect and anticipate it will be guilty as to all of those 30 counts and we should point out that that jury of seven women and five men did their job inasmuch as we know there were two jury questions, ....

Decide whether tsarnaev is eligible for the death penalty. and to do that they re going to be given aggravating factors, such as significant planning or was the crime committed in the course of other crimes? was the killing committed in the course of other crimes or and then the jurors are going to have to find one of the factors and there s many non-statutory factors that the government can present. if they don t find any of those factors, then they cannot select death. first, they re going to be asked to find an aggravated factor. if they do likely in this case an aggravating factor exists, they ll be given other aggravate aggravating factors and mitigating evidence from the defense and asked to select between death and life. let s talk about the defense for a moment because judith clark is his lawyer and she s got a very good record of keeping very big names off of death row. ....

Whole again. thank you. mr. stein, on the day this happened you violated several laws that are specifically designed to protect public safety. your driving then produced tragic and completely avoidable results. there is no amount of time that will bring back the two young people, but you need to be punished for this. mitigating against that somewhat according to the statute is you don t have any prior adult convictions. you don t have anything that would raise this level of offense to another level of offense. on count two, the sentence will be 24 months in the state penitentiary. and you will pay a $10,000 fine. on count four, 24 months in the state penitentiary, you will pay a $10,000 fine. those sentences will run consecutive to one another. and you will have a lifetime driving suspension and will also pay court costs. i guess my hopes were kind of ....
