Cops Had No Basis to Stop Elijah McClain Before His Death: Panel

Police lacked reasonable suspicion to stop the late 
Elijah McClain, with one officer refusing to wait more than 10 seconds to literally get their hands on the 23-year-old in a confrontation before his death, an independent commission in Colorado found on Monday.
“In interviews with the Aurora Police Department’s Major Crime/Homicide Unit (‘Major Crime’) investigators, none of the officers articulated a crime that they thought Mr. McClain had committed, was committing, or was about to commit,” the three-member panel from the city of Aurora, Colo. found in a 157-page report. “They provided the following reasons, none of which under the prevailing case law is sufficient to establish reasonable suspicion: Mr. McClain was acting ‘suspicious,’ was wearing a mask and waving his arms, and he was in an area with a ‘high crime rate. ” ....

Elijah McClain Death Independent Investigation Findings


The City of Aurora just released the report of a self-described independent investigation team commissioned by Aurora City Council, which was charged with investigating the August 30, 2019, death of Elijah McClain, who lost his life six days after a controversial attack by Aurora Police Department officers.
The 157-page report, which will be discussed during a presentation before the council at 5 p.m. today, February 22, doesn t reach any conclusions regarding whether officers and emergency personnel deserve punishment for their actions during the August 24, 2019, incident. But authors Jonathan Smith, Dr. Melissa Costello and Roberto Villaseñor find significant flaws in virtually every aspect of the response and investigation into the tragedy, and recommend sweeping review and reform. ....
