First Nations backing Ottawa’s plan to phase out salmon farms in the Discovery Islands feel betrayed after a court ruled in favour of aquaculture companies looking to restock fish at their sites in the region. On Monday, Federal Court Justice Peter George Pamel said Mowi Canada West and Saltstream would suffer substantial harm if they couldn’t transfer juvenile fish into three farm sites in the area. But Homalco Chief Darren Blaney said the companies’ win comes at the expense of wild salmon and all the First Nations dependent on the fish for food, and economic or cultural reasons. ....
Aquaculture companies have won a court victory that appears to overturn aspects of a recent federal government decision to phase out contentious fish farms in the Discovery Islands. A Federal Court judge has ruled in favour of Mowi Canada West and Saltstream a small aquaculture company which challenged Fisheries Minister Bernadette Jordan’s policy decision to ban the restocking of pen sites in the region ahead of the June 2022 fish farm phaseout. The court injunction should allow Mowi to transfer 1.2 million Atlantic salmon smolts to its Phillips Arm and Hardwicke farm sites in the waters near Campbell River on Vancouver Island, said Dean Dobrinsky, human resources director for Mowi. Saltstream aims to transfer 10,000 chinook salmon to its Doctor Bay site in the region. ....
VICTORIA A spokeswoman for an environmental law charity says she s disappointed by a federal court ruling that suspends a government ban on restocking three fish farms in the Discovery Islands. Ecojustice lawyer Margot Venton says the decision earlier this week sets a concerning precedent and could jeopardize wild salmon when they migrate to the ocean this year and next. Justice Peter George Pamel s ruling relates to the ban imposed in December by the federal fisheries minister on new fish transfers to the farms that are to be phased out by July 2022. Pamel says Mowi Canada West and Saltstream claim the transfer of fish is a vital part of operating under their aquaculture licences. ....
