O STJ, por meio de julgamento de sua 4ª Turma, definiu interessante questão sobre aplicação da inversão do ônus da prova, com base no Código de Defesa do Consumidor (CDC), em ação civil pública movida pelo Ministério Público.
No caso em concreto sob análise, cuidava-se de ação civil pública proposta pelo Ministério Público, com base em investigação realizada por Grupo Especial de Controle Externo da Atividade Policial e ABIN, para proteger direitos de segurados (consumidores) e difusos (futuros consumidores), que contratam seguro de veículo e alegadamente sofreram sinistro e danos que não foram indenizados por seguradora, sob a alegação de fraude contra o seguro.
