St. Paul, MN (KROC-AM News) - The Minnesota Supreme Court has upheld a Rochester man s conviction on a first-degree murder charge, but also found the judge in his case erred when he also entered a second-degree murder conviction into the court record against Malcolm Woods.
The justices, following precedent, found a person cannot be convicted of both first and second-degree murder for the same crime. The ruling remands the case back to Olmsted County Court for a future hearing to remove the second-degree murder conviction from the record.

Woods is currently serving a life sentence for shooting and killing 38-year-old Brandon Arndt when the victim answered a knock on the door to his mobile home in southeast Rochester in the fall of 2018. His half-brother and half-brother’s girlfriend were also convicted of charges connected to Arndt s murder and are serving prison sentences.

Just more than four months after the mother of 38-year-old Brandon Arndt asked an Olmsted District Court judge for leniency for the 22-year-old charged in connection with her son s murder, the North Mankato, Minn., man asked to be sent to prison.
According to court records, Darien Klindworth-Woods requested on Jan. 15 to execute a stayed 46-month prison sentence. He is being held at the Olmsted County Adult Detention Center without right to bail pending his move to state prison. He will receive credit for 374 days already served.

22-year-old Darian Klindworth-Woods went before an Olmsted County judge on Friday and requested the execution of the nearly 4-year prison sentence. The Mankato man was placed on probation last year after he entered a guilty plea to aiding an offender for his role in the shooting death of 38-year-old Brandon Arndt at a southeast Rochester mobile home park. Klindworth-Woods was given credit for the 374 days he previously served in jail.
