The Supreme Court of Appeal has upheld an application from a religious organisation after an Isipingo Beach resident interdicted them from sounding an amplified call to prayer.
The Supreme Court of Appeal has overturned a controversial Durban high court ruling directing an Isipingo Beach madrasah to “mute” its azaan (call to prayer) so they could not be heard from a neighbour’s property.
The Durban High Court in August 2020 found the call to prayer, or azaan, from the Madrasah Taleemuddeen Islamic Institute in Isipingo Beach, interfered with its neighbour, Chandra Ellaurie’s, private space and constituted a nuisance. The SCA handed down its ruling on Thursday.
