The Supreme Court of India has ruled against legalizing same-sex marriage in a 3:2 verdict. The court refused to strike down provisions of the Special Marriage Act that would include same-sex marriages, stating that it is the responsibility of the legislature to frame such laws. However, the court did grant several other rights to the LGBTQ community, including protection against discrimination, the right to choose a partner, the right to intimate association, and the right to adopt children.
The Supreme Court of India began hearing petitions seeking the legalisation of same-sex marriage on April 18, 2023. Whether Supreme Court, or Parliament, will pave the way for same-sex marriage in the coming days will be seen, but the question that has come up for the debate on marriage equality is whether same sex marriage is an 'urban elitist concept' or integral right in comparison to other rights enshrined in the Indian Constitution.
