The Court said that the Scrutiny and Interview Committees of KMRL had no authority to deviate from the notified qualification with respect to the minimum age of a candidate, whether it be for nineteen days or one day.
Justices A Muhamed Mustaque and Kauser Edappagath issued the judgement on the case which was built solely on circumstantial evidence against the accused.
The Court said that under relevant principles of Hindu Law, a Deity and minor are treated similarly and that High Court must apply the doctrine of parens patriae and act as guardian of the Deity .
"Anything that would hinder the ability of the spouse to blossom into his/ her fullness and to enjoy life in matrimony must be held to fall within the sweep of Section 10(1)(x) of the Divorce Act", the Court said.
