MANHATTAN (CN) Denying the public access to felony juvenile records for cases tried in adult court is unconstitutional, the Second Circuit affirmed Monday. 
The 30-page, unsigned opinion sides with the Hartford Courant, Connecticut’s largest daily newspaper, in its challenge to state limits on who can access high-profile juvenile matters, including that of Kennedy cousin Michael Skakel. 
Part of a 2019 amendment to Connecticut’s Juvenile Transfer Act, the confidentiality rule pertains to cases where a defendant between ages 15 and 18 is charged with certain felonies, including murder, armed robbery and rape. Law360 (February 1, 2021, 4:44 PM EST) The Second Circuit on Monday affirmed a Connecticut federal district court s order blocking provisions of a law that mandates automatic sealing of all judicial records and prevents public access to criminal proceedings of juvenile defendants who are transferred to adult courts.
In a 28-page order, a three-judge panel upheld a decision by the U.S. District Court for the District of Connecticut in July agreeing with the publisher of the Hartford Courant, the largest daily newspaper in the state, that two confidentiality provisions in the state s Juvenile Transfer Act violated the First Amendment. ....

MANHATTAN (CN) Connecticut’s largest daily newspaper fought at the Second Circuit on Wednesday against a state rule that has barred access to high-profile juvenile trials like that of Kennedy cousin Michael Skakel.
Except for victims and their family members, Connecticut law keeps confidential felony juvenile court cases that have been moved to adult court, which is otherwise accessible to the public.
