Johannesburg - Outgoing Chief Justice Mogoeng Mogoeng will have to use part of his three-and-a-half months long leave to deal with the Judicial Conduct Committee’s sanction that he apologises for his pro-Israel comments.
Chief Justice Mogoeng’s appeal of retired Gauteng Judge President Phineas Mojapelo will be considered by the committee next month at the Constitutional Court.
Judge Mojapelo ordered Chief Justice Mogoeng to publicly apologise and issue a retraction of the statements he made last year during a Jerusalem Post webinar, at which he claimed to be under an obligation as a Christian to love Israel and pray for Jerusalem’s peace, which he said meant the Middle Eastern country’s peace. ....

Chief Justice Mogoeng's 'long leave' owed to him, it's not unusual, says his office

Mogoeng has taken leave after serving a period of four years of actual service. 
The decision by Chief Justice Mogoeng Mogoeng to take three-and-a-half months leave is normal judicial procedure and nothing untoward, his office says.
In a statement released on Thursday afternoon, Constitutional Court spokesperson Nathi Mncube said Regulation 3 of the Judges Remuneration and Conditions of Employment Act of 2001 provides for judges to take leave of three-and-a-half months for every period of four years actual service.
This leave is referred to as long leave within the judiciary. The chief justice s four-year cycle to take his long leave commenced on 1 July 2018, but he was unable to take it due to his judicial and extra-judicial commitments. ....

Johannesburg – The office of outgoing Chief Justice Mogoeng Mogoeng on Thursday explained his decision to take long leave five months before his term at the helm of the country’s judiciary ends.
Mogoeng’s office announced on Friday he was taking long leave from May 1 after informing President Cyril Ramaphosa and Justice and Correctional Services Minister Ronald Lamola.
According to Nathi Mncube, the spokesperson for the judiciary, regulations promulgated in terms of the Judges’ Remuneration and Conditions of Employment Act 2001 provide for judges to take leave of three and a half months for every period of four years’ actual service. ....

Office of the chief justice clarifies Mogoeng's 'long leave'


Chief Justice Mogoeng Mogoeng has moved to play down speculation about why he has taken long leave before his term of office comes to an end.
The office of the chief justice announced on Wednesday that President Cyril Ramaphosa had appointed Justice Sisi Khampepe as acting chief justice while Mogoeng was on long leave.
Khampepe’s appointment is effective on May 1.
Having an acting chief justice is unprecedented.
The statement explained that, because of his involvement with the commission of inquiry into state capture, Deputy Chief Justice Raymond Zondo was not available to step into Mogoeng’s shoes.

Mogoeng latest: Judiciary clears the air over Chief Justice's leave


The Judiciary has made it clear that there is no funny business associated with Chief Justice Mogoeng Mogoeng’s decision to take an extended period of leave, with a statement released on Thursday 6 May aiming to dispel rumours that he is set to leave his position.

Spokesperson for the Judiciary, Nathi Mncube, said in the statement that the nature of Mogoeng’s leave period, which came into effect on May 1, is in line with the regulations permissible in terms of the Employment Act. 
“Regulation 3 of the Judges’ Remuneration and Conditions of Employment Act, 2001 provides for Judges to take leave of three and half months for every period of four years’ actual service,” she said, adding that the leave period is lengthier than many may have expected but that this is perfectly appropriate given the work he has done since 2018.  ....
