Lenasia Business Granted Interim Relief After Franchise Agreement Battle

The Johannesburg High Court has granted interim relief to a business in Lenasia after a franchise agreement battle.
Judge Faeeza Kathree Setiloane upheld an application brought by Superb Steel who trades as Incredible Money against Cash Crusaders for interim stay on writ of execution.
Four applications were brought by Incredible Money before courts.
The case stems from Superb Steel’s decision to terminate their franchise agreement with Cash Crusaders owing to the fact that the franchisor allowed three other stores to be opened in close proximity to each other.
An arbitration award was handed down confirming the cancellation of four franchise agreements which Cash Crusaders had entered into with Superb Steel, and directing Superb Steel to pay about R11 million in damages to Cash Crusaders for the early termination of the franchise agreement.
They are taking place in the context of former minister Sydney Mufamadi’s testimony to the Zondo Commission that during the Zuma era, the State Security Agency set aside millions to buy off judges hearing matters involving former president Jacob Zuma.
And they are taking place in the context of an imbroglio revolving around Chief Justice Mogoeng Mogoeng’s public criticism of South Africa’s relationship with Israel: comments for which he has been ordered to apologise by the Judicial Conduct Committee and thus far refuses to comply.
Little wonder, then, that there appeared to be tension in the air at the interviews to fill two vacancies on the Constitutional Court this week, with questions heavy with subtext.
JSC selects five names for Ramaphosa in Concourt vacancy race

Johannesburg - Following extensive two-day interviews, the Judicial Service Commission (JSC) has selected five candidates for two vacancies at the Constitutional Court.
The JSC concluded interviews on Tuesday night following interviews with eight candidates.
The selected five candidates include; High Court Judge Fayeeza Kathree-Setiloane, High Court Judge Jody Kollapen, Supreme Court of Appeal Judge Mahube Molemela, SCA Judge Rammaka Mathopo and Judge Bashier Vally.
The five names, two women and three men will be submitted to President Cyril Ramaphosa for him to decide on the final two candidates who will fill the two vacant posts at the apex court.
