South Africa has witnessed seismic judicial shifts in the last week, which have a profound moral and constitutional impact on justice, accountability and the rule of law. The Supreme Court of Appeal (SCA) rejected Joao Rodrigues’ appeal against his indictment for the murder of Ahmed Timol. It was followed by the groundbreaking Constitutional Court’s judgement confirming former President Zuma’s contempt of court, and sentencing to 15 months in prison. Judge Sisi Khampepe, speaking for the majority stated ““[i]n our system, no one is above the law. Even those who had the privilege of making laws are bound to respect and comply with those laws.” ....

Former Transnet exec loses appeal against R18m asset seizure

The Special Tribunal of the state’s corruption-fighting investigating unit has denied a former Transnet executive leave to appeal its ruling that his assets must be seized pending civil proceedings.
Former Transnet group executive for capital projects Herbert Msagala is accused of receiving R18.4 million as part of tender corruption. 
The Special Investigating Unit (SIU) brought its case against Msagala to its tribunal in July 2020.
It related to a contract for a fuel pipeline between Durban to Heidelberg. IGS Consulting Engineering Services CC, whose sole member was Sipho Sithole, was awarded contracts as part of the project.  ....

The beleaguered SAPS Crime Intelligence, after being alerted by a “minister in the security cluster”, uncovered  a threat of “some magnitude” to the country’s “national security” just prior to the ANC’s 2017 elective conference at Nasrec.
Another Zuma-dominated security actor, the State Security Agency (SSA), on the other hand, did a sweep and found no immediate threats and continued to monitor the conference until its conclusion on 19 December, with no major threats detected.
