The feud between the executive and judicial branches of our federal government began with the first transition of power in the presidency, as the Democratic Jeffersonians took over from the federalists. The Jeffersonians loathed the conservative interpretation of the U.S. Constitution expounded through the John Marshall court. But the first actual assault upon SCOTUS took place under Democrat Andrew Jackson, the seventh president. When Marshall’s court twice ruled against his actions, Jackson simply ignored SCOTUS and went ahead despite the illegality of his actions.
The idea of attacking the U.S. Supreme Court (SCOTUS) began with Theodore Roosevelt whose supporters loathed the judicial restraint seen in the high court, and who thus assaulted the sanctity of the court. In the twentieth century, only four nominees to serve on the Supreme Court of the United States have been rejected; all were the nominees of a Republican president and three of the four were rejected by Democrats, who controlled the United States Senate. John J. Parker, was the first nominee to be rejected by the U. S. Senate in a span of 72 years. Parker was also the only one of four nominees to be rejected by a Senate controlled by his own political party.
