Kentucky Bill Would Set Foundation to Block Unconstitutional National Guard Deployments
FRANKFORT, Ky. (Feb. 9, 2021) – A bill introduced in the Kentucky Senate would empower the governor to stop unconstitutional foreign deployments of the state’s National Guard troops. Passage into law would take a step toward restoring the founders’ constitutional framework for a state-federal balance.
Sen. Adrienne Southworth (R-Lawrenceburg) introduced Senate Bill 173 (SB173) on Feb. 4. Under the proposed law, the Kentucky governor could only release the state’s National Guard units into “active duty combat” if Congress has :
1) Passed an official declaration of war; or
(2) Taken an official action pursuant to Article I, Section 8, Clause 15 of the United States Constitution to explicitly call forth the Kentucky National Guard to execute the laws of the union, repel an invasion, or suppress an insurrection.
