Well, the problem with that, if youre not the party for whom the judge has empathy, youre in for a pretty rough ride. This administration, the trump administration, has taken the approach, the rather quaint approach that the judge of a judge is try to interpret the law as its written. Justice scalia used to say if youre not uncomfortable occasionally with the outcome youve reached, youre not a very good judge. Justice gorsuch said, judges dont wear red, dont wear blue, they wear black. We are this week going to confirm four circuit junction.
