Wayne candidate asks court to intervene over House seat


WAYNE — A former candidate is seeking legal action against the Wayne County Republican Executive Committee, claiming actions to replace former Del. Derrick Evans violated the law.
Jason Stephens, a former Republican candidate for the West Virginia House of Delegates for the 19th District, is asking the West Virginia Supreme Court to stop the “improper and illegal” replacement of Evans, according to a prepared statement from Stephens.
Stephens claims that after the Wayne County committee violated procedures to replace Evans — who resigned after he was charged with illegally entering the U.S. Capitol with a mob of Donald Trump supporters Jan. 6 — the West Virginia State Republican Executive Committee intervened to correct the situation, but ultimately ended up violating protocol as well. ....

Governor, state GOP say Wayne County delegate vacancy was filled correctly

CHARLESTON – Gov. Jim Justice maintains the first list of potential replacements from Wayne County to fill a recent House of Delegates vacancy did not meet state code, and the state Republican Party agrees.
The governor’s office, through Attorney General Patrick Morrisey’s office, submitted its response February 1 to a petition filed by Wayne County Republican Executive Committee Chairman Jeff Maynard, who says Justice did not follow law in how he chose a candidate to fill the seat vacated by Derrick Evans, the lawmaker who took part in the January 6 storming of the U.S. Capitol.
In its own response, the state Republican Party agrees with the governor’s office. ....

CHARLESTON The Office of Gov. Jim Justice issued its response to the lawsuit over the process involved in selecting the next Republican lawmaker from Wayne County.
The West Virginia Attorney General’s Office filed a response Monday to a lawsuit filed by the chairman of the Wayne County Republican Party with the state Supreme Court of Appeals.
Wayne County Republican Executive Committee Chairman Jeff Maynard is asking the court to order Justice to appoint a replacement for former Republican House of Delegates member Derrick Evans from a list of three nominees submitted by the county on Jan. 14. ....

CHARLESTON A motion by the West Virginia Republican Party to intervene in a case that could determine who represents Wayne County in the House of Delegates was approved Friday by the state Supreme Court of Appeals.
J. Zak Ritchie, an attorney for the state Republican Party, filed a motion to intervene in a mandamus lawsuit filed by Wayne County Republican Executive Committee Chairman Jeff Maynard asking the court to require Gov. Jim Justice to choose a delegate for the vacated 19th District House seat in Wayne County from a list of three qualified nominees submitted by the county party. ....
