There seemed to be agreement that Mitchell Fire/EMS can use the UTV but not on how it should work or where the vehicle should be parked if it’s needed.
The county board denied a request from Jensen Capital and Development, of Mitchell, to rezone a parcel of land from agricultural to rural residential and to build 20 lots for two-acre home sites.
“This would essentially resolve the lawsuit, as the plaintiff (Jeff Bathke) has agreed to dismiss the suit if the variance is voided,” City Attorney Justin Johnson said of the lawsuit.
