KUALA LUMPUR, Malaysia, June 15, 2022 /PRNewswire/ Malaysia's leading food and beverage company Fraser & Neave Holdings Bhd (F&NHB) shared the joys of Hari Raya Aidilfitri with an annual nationwide programme to support over 500 individuals and families from vulnerable communities, totaling over RM 45,000 in contribution distributed. The programme was conducted across the states, including Kuala Terengganu, Kota Bahru, Kuantan, Johor Bahru, Seremban, Penang, Ipoh, Klang Valley, Kota Kinabalu and Kuching, and saw 70 F&N volunteers contributing over 170 hours to the community. PERSONAL LAWS AND JURISDICTION OF SECULAR AND SYARIAH COURTS Article 121(1A) of the Federal Constitution (‘Constitution’), read together with the Ninth Schedule, List II, Item 1 of the State List, provides that secular courts ‘shall not have jurisdiction in respect of any matter within the jurisdiction of the Syariah courts’ (‘State List’). The State List provides for personal laws affecting persons professing the religion of Islam and the jurisdiction of the Syariah courts is exercisable on two conditions. First, the person professes the religion of Islam (‘Legal Persona’). Second, the matter falls within the subject-matter enumerated in the State List (‘Subject-matter Jurisdiction’). ....

Yes, it may be dubbed as a non-populist judgement. Apparently, the Federal Court, to its credit, opted not to play to the gallery. After all, that is the sacrosanct duty of any court of law - deciding every case before it purely based on the evidence presented by all the relevant litigants. Attempting to be populist should not become the business of any court of law. The court is tasked to deliver justice according to the law, not to deliver any popular judgement by ignoring it. ....
