all the big moments and the network s new mission. welcome back to early start. i m dave briggs. i m christine romans. it is tuesday, august 21st. 5:00 a.m. in the east. let s start with the latest. conservative think tanks in the u.s. senate. united states senate the latest targets of hackers linked to military intelligence. microsoft stopped the attack last week. the company took control of six web sites operated by the same group behind the 2016 dnc hack. let s bring in fred pleitgen. reporter: the organization that we re talking about, the hacking group, called fancy bear. that is the group that hacked into the dnc and hillary clinton campaign in 2016. u.s. intelligence highly likely believes this group is linked and possibly directed by russian military intelligence known as the gru.

back in the jury room. so how this all unfolded, just after 11:00 a.m., the jury did send a note to the court asking the judge, judge, what do we do if we can t come to a unanimous decision on one of the 18 counts. that implies that perhaps they have reached a decision unanimously on the other 17 counts, but they haven t said that definitively. what the judge had to do was he had to come up with instructions to give the jury as it pertained to them going back and deliberating yet again. that just happened. in just the past few minutes, the judge instructed the jury, go back into the jury room and continue to work on that one final count. try to continue to work, to come to some unanimous verdict on that one remaining count. outside of the presence of the jury, the judge indicated that he might be prepared to accept a partial verdict if they weren t able to come to a conclusion on that one remaining count that they s ....

the jury that there is a third option, there is guilt, there is not guilty, and there is a hung jury. the judge declined to do that and said that if the jury were to come back again and say they remain deadlocked, the judge will ask them how many counts they ve reached a verdict on. he ll then consult with the lawyers and decide whether or not to take what s called a partial verdict which means to have the jury announce those counts to which they ve reached unanimous agreement. now, correct me if i m wrong, the trials that i ve covered in the past, dan, and you re the lawyer and former prosecutor, a judge will only repeat that allen charge so many times, or else risk, you know, being overturned on appeal if it ends up being a conviction, that east putting too much pressure on a deadlocked jury. you re exactly right, andrea. even the judge mentioned that his objective ....
