This case actually doesn t raise that question. if you stick to the bare facts of the case, it s can the president be subjected to a subpoena for things that happened before he became president? now, the checks were actually made out to reimburse michael cohen after the president was elected. but you may remember in 1974 president nixon had to turn over white house tapes in response to a subpoena. so there is some precedent here to say that a president is not beyond the reach of a subpoena for evidence. there are other factors at work here. no one is asking specifically the president for nif his documents. these are subpoenas for the trump organization and to his accounting firm. as one judge asked today, it can t be intrusive on the president s time. he doesn t have to do anything. these aren t requests for him for documents. but in any event, it s headed to the supreme court. heth they wou whether they would actually get ....
