INDIANAPOLIS The Indiana Supreme Court heard arguments Thursday involving a Wayne County lawsuit.
Judy Reece filed the lawsuit after her husband, Walter Reece, sustained permanent injuries in an Aug. 10, 2014, crash while riding his motorcycle south of Cambridge City. Tyson Foods Inc. is the only remaining defendant in the lawsuit, and was accused of having high vegetation on its corner property that impeded vision and contributed to the crash.
Special Judge Jay Toney of Randolph Circuit Court granted a summary judgment in Tyson s favor, and the Court of Appeals of Indiana upheld that decision. However, Senior Judge John G. Baker wrote a dissenting opinion that summary judgment was not warranted. A summary judgment occurs when no material facts are in dispute and the ruling occurs merely based on law without a trial.
