Divorcee sues Bexar County probate judge after $262,000 in sanctions over elderly millionaire's guardianship

SAN ANTONIO - The divorcee who was fined ‘hundreds of thousands of dollars in the guardianship of an 83-year old millionaire has filed a lawsuit against the Bexar County Probate Judge who sanctioned her.
Laura Martinez sued the Honorable Oscar Kazen in his official capacity in the 150th Judicial District on April 16, alleging he grossly neglected to use reasonable diligence in the performance of his mandatory duty under Texas Estates Code Subchapter A in the guardianship of Charles Thrash, according to a press release.
“Laura requests the court, upon final hearing on the merits, to grant her request that Charlie s estate be reimbursed for actual damages, including hundreds of thousands of dollars in attorney s fees awarded, wrongfully incurred and paid to the guardian s attorneys between April 17, 2019, to the present date, which may be payable on Judge Kazen’s judge’s bond,” wrote Martinez’s attorney Phil Ross in t ....

The Honorable Oscar O. Efird was a native of Winston, North Carolina. He graduated with honors from Roanoke College in 1912. After receiving his master s degree from Princeton University, he worked briefly with his father in Winston. A decision to enter the legal profession prompted him to enter Harvard Law School, where her received his LL.B. in 1919.
Judge Efird joined the law faculty of the University of North Carolina where he taught for two years before beginning his law practice in Winston-Salem. At age 35, he was named judge of Forsyth county court and received seven tw0-years commissions from subsequent governors of North Carolina. He was the youngest judge of comparable jurisdiction in the state. ....
