Judge Dorothy Degabrielle refuses to recuse herself in Mpinganjira's bribery case

Judge Degabrielle made the ruling today at the High Court in the commercial capital Blantyre.
The Judge described Mpinganjira’s application as ill timed hence she will not recuse herself.
She said Mpinganjira indicated he was going to enter defence and must enter defence as planned.
Commenting on the screenshot purportedly from Degariele to Mpinganjira, she notes that the screenshot does not have other elements of a valid screenshot, including her phone number or a name, in case her number was saved.
She queries if a reasonable person looking at the whole issue would conclude likelihood of bias or that there is someone engineering to derail the case. ....

Malawian To Face Trial For 'Bribing Election Judges'

A Malawi court has said businessman Thomson Mpinganjira - accused of attempting to bribe election judges - has a case to answer, which paves the way for a full trial.
Mr Mpinganjira was accused of attempting to bribe a panel of five judges who were hearing an opposition challenge to the presidential election results.
Peter Mutharika had been declared winner by the Malawi Electoral Commission of the May 2019 election.
The constitutional court annulled his victory in February last year, but Mr Mpinganjira is alleged to have tried to coerce them to rule in favour of Mr Mutharika.
The businessman denies wrongdoing and through his lawyers, he had asked the court to throw out the case on grounds that it lacked merit. ....

High Court Judge Dorothy DeGabrielle has found business mogul Thomson Mpinganjira with a case to answer in his alleged judges bribery case.

She says evidence that the State brought before the court proved elements of attempting to bribe the judges that presided over the historic presidential election nullification case.
Mpinganjira has been told that he can enter his defence or remain silent as per his Constitutional rights.
Mpinganjira’s lawyer Patrice Nkhono has since told the court that they will have to discuss the ruling first before pondering on the next move if witnesses will be paraded or not. ....

Absence of suspect in albino murder matter of Buleya Lule stalls case

Absence of a suspect in the murder case of a suspect in the person with albinism murder case has forced the High Court in Lilongwe to adjourn the case.

The 13 suspects in the murder of Buleya Lule, all police officers, failed to take plea after one of them failed to show up at the High Court in Lilongwe.
Lule who died in police custody in 2019, was a suspect in the abduction of a 14 year old boy with albinism.
Later, 13 police officers were arrested in connection to his death after a Malawi Human Rights Commission report revealed that Lule was murdered and that he died before he was taken to the hospital. ....
