The Supreme Court had earlier told the High Court to decide on the plea expeditiously. Since the bail plea could not be taken up by the High Court despite such a direction, the top court decided on the matter itself.
The guidelines were framed in line with the Supreme Court's directives in the case of Md. Asfak Alam v. State of Jharkhand, in which the top court had called for authorities to refrain from making unnecessary arrests.
The Court also declined to entertain Dar's plea for an inquiry against Justice Wani on noting that the lawyer had already filed a separate complaint against the judge before the Chief Justice, which was still pending.
