CNN CNN Tonight With Don Lemon November 15, 2019 03:19:00

This is somehow unreliable. we re not there yet, number one. we re in the analogous scenario to a grand jury investigative proceeding, which essentially in a criminal case, you could have always used hearsay in order to charge a particular defendant. it s not until an actual trial the issues of credibility and reliability come into play. got it. even if that s the case, the senate could still look at these things because we re not tied to the hearsay rules in an impeachment proceeding. this is really, really a red herring. gotcha. thank you for saying that and explaining it. let s bring in michael who has been sitting by patiently. michael, can we look ahead? lawyer for the white house budget official mark sandy says he llsubpoe subpoenaed. he s breaking ranks with the white house. that s a big deal. it is, potentially. obviously, we need to see exactly what he has to say and whether he has any direct information as to the reason for the suspension of aid. i think we pretty muc ....

Secondhand, third hand. this is why we have hearsay rules in court the further you get from the source the less reliable the information comes. great analysis, as usual. eli honig, thank you so much. tweet me or go to my facebook page. i will read some of my stuff from facebook. does the whole fiasco put pressure on mueller to work quicker? ashton, i don t think he feels any pressure whatsoever to deliver this report before it s time and probably what makes his job that much more difficult is that as he investigates new leads come up to take him in a whole variety of directions he never could have forecast. that s speculation on my part. it makes it harder and harder to wrap it up. i get your point. we all wish we could move on one way or another. go to my website at smerconish.com. answer the question do you believe krob rakes will emerge in the form of e-mails, texts or ....

Which he pled guilty. they may not have quite that much yet about the president of the united states. that s one reason. the second is they may be subscribing to the same view, that they can t indict the president of the united states, or maybe the southern district of new york shouldn t be the office to make that decision. and so the fact that the president hasn t been charged doesn t mean that there s not enough evidence. it just means that maybe we re not there yet. what i think is clear, though, is because what michael cohen al kutted to, what he admit theed it s not just his own crimes, he effectively admitted to a conspiracy. that makes the president of the united states ab unindicted co-conspirator. unindited co-conspirator is a famous phrase because we think of the floating head of richard nixon appears in our minds when we think of that. what are the material impliks of that? there aren t any really. the reason that the designation is usually useed is for evidentiary reaso ....

Months in the summer of 2016. jack, we re lucky to have you because i have a legal question that may come up and be germane as we learn more. paul mentioned, the president said he quoted a client in russia and so on and so forth. that would be, i guess, in the eyes of it law in other cases hearsay. but i understand in a case like this hearsay rules are different, is that correct? hearsay is just a statement made out of court in court. so hearsay is perfectly appropriate and used all the time in interviews with witnesses or defendants, in grand jury testimony. so there s nothing unusual about ....

In this field who will credibly argue military commissions is a better idea, that s what we ought to do, we ve had a better experience with them? the only argument that makes any sense to me for the commissions is there is a lower standard of proof on the evidentiary issues. for example, the hearsay rules are more lenient, and you only need 2/3 of the jury to convict as opposed to unanimous jury. so if you had a case where it was a close call and you weren t sure if your evidence was up to snuff, you can see going with the commission. in a case where the evidence is strong and i don t have any inside information on this, but there seems like there s strong evidence, you should go with the civilian court. particularly given that softball question about the record. this is helpful to understand the substantive matters. jennifer rogers, thank you very much for being with us. that really helped. we ll be right back. stay with us. ....
