Seen anyone trashed in the news media like this guy. i mean, the one thing we know about him, is that he was in prison, in effect, with the taliban for five years. and as soon as he gets out, everybody wants to throw him back in jail. it s kind of amazing to me. but, okay. just to answer your questions, since you asked, desertion, the maximum penalty in not a time of war is five years. but desertion is very hard to prove, because you have to prove the the military would have to prove he had no intention of returning to his base. and that s a little different difficult to prove. going awol, which is a little easier on the government, 18 months is the maximum penalty. okay. and i hear your first point, by the way, loud and clear. let me pifrt, just because i want to move off bowe bergdahl. this just came in moments ago to us from washington about this bill sponsored by senate democrats, showing the opposition to the supreme court s decision over hobby lobby, its ruling on contracep ....

Evidence to come in. what do you think about this? first of all, i don t know whether it s true or not. doesn t seem to be anybody else deserted. you have a lot of soldiers testifying against him saying he deserted. he certainly was at least awol if not a deserter. nobody else seems to have done it and they were in the same unit. so i don t know how much of a defense that s going to be. and is isn t a defense at all. you can t say, i m going to desert because i don t like the conditions of my unit. my boss stinks. i m leaving. but how about in the time of war? first of all, conditions in units in times of war are always stressful. if you allowed this as a defense, half the unit could walk out. benefit of the doubt has been given to him, but not those who have given their testimony of being there right with him in the platoon. why? i m willing to give him the benefit of the doubt, but at a minimum, he walked away, which he s awol. maximum he s a desert. somebody has to figure ....
