I don t know if this quite raises to the level of hostility but it sure doesn t look good. it looks like she s headed in that direction. she would have the most trouble with senators murkowski and collins in this case. that s why i think for a while it looked like it was between kethledge and kavanagh until mcconnell sort of made this last weekend overture. republicans like, he s from pennsylvania, used to drive a taxi, has a great story. now he s back in the mix as somebody who the president can really get behind and so could possibly we should also mention his secret weapon, judge hardiman s ....
Over the other contenders? well, they might have the fewest red flags. so other than judge barrett, all three of the men that you mentioned have all been on the federal appeals court for a long time. but judge kavanaugh has the deepest record from his work before then. he worked in the george w. bush administration as staff secretary and in the white house counsel s office, and even before that he was a top deputy to ken starr in his probe of bill clinton and was a principal author of the report that led to president clinton s impeachment. all of that has a lot of potential ammunition for democrats opposing his nomination. judge barrett was an academic for a long time, wrote a lot of things particularly about the issue of abortion and other issues, and those also could provide fodder for democrats trying to oppose her. is hardiman a more moderate pick here if the president were to go with hardiman? i know he was also the runner-up to gorsuch. ....
He has served alongside president trump s sister in pennsylvania. is he the more moderate pick, seeing he doesn t have the paper trail with regards to roe v. wade and that s what the democrats are going to hone in on with this pick? he might be perceived that way. it is a narrow band we are talking about. these are all conservative judges who in all likelihood will be conservative justices. in some ways he is a safer choice. he hasn t had as many hot button issues as some of the other people. judge kavanaugh being on the federal appeals court here in washington has had a huge number of regulatory cases that could pose issues, could let democrats portray him as anti-consumer or something like that. judge hardiman has had some second amendment cases, hasn t had to directly deal with abortion. so there might be, you know, while republicans i think would still be confident in the kind of justice he would be, he might be a little harder to oppose. greg store for us. thanks, greg. sure ....
It would be interesting. if she was selected, we d get a scalia clerk pick for the kennedy seat and a kennedy clerk pick for the scalia seat, justice gorsuch. bill, you get the last word. you ve been critical of the president but if he picks another conservative judge will you approve? yeah, it s a good list, i agree with ken on that. i talked to people who talked to the president or people close to the president, i think kavanaugh will not get it. i this he s a good judge but he s a d.c. circuit judge, an insider. easy for democrats to attack on those grounds and doesn t add anything. i think the two judges in the midwest, hardiman and kethledge give you more of a gorsuch-li gorsuch-like people who didn t go to ivy league law schools and i agree with ken that amy barrett would be a risky and daring pick so the decision becomes a confirmation ....
