Wednesday, January 20, 2021 H-1B Cap Selection Process On January 8, 2021, U.S. Citizenship and Immigration Services (USCIS) published a final rule modifying the H-1B cap selection process. This rule changes the H-1B cap selection process by replacing the random selection process with a wage-level-based selection process, giving preference to petitions using a Level IV wage and proceeding in descending order with wage levels III, II and I. This affects only new, cap-subject H-1B petitions. It does not affect people who currently hold H-1B status. The rule is scheduled to go into effect 60 days after publication (March 9, 2021), however, it is unclear if it will be implemented in time for this year’s cap process. ANI | Updated: Jan 08, 2021 06:17 IST Washington [US], January 8 (ANI): USCitizenship and Immigration Services (USCIS) has announced a final rule that will modify the H-1B cap selection process, amend current lottery procedures, and prioritize wages to protect the economic interests of US workers and better ensure the most highly skilled foreign workers benefit from the temporary employment program. Modifying the H-1B cap selection process will incentivize employers to offer higher salaries, and/or petition for higher-skilled positions, and establish a more certain path for businesses to achieve personnel needs and remain globally competitive. The H-1B temporary visa program has been exploited and abused by employers primarily seeking to fill entry-level positions and reduce overall business costs, said USCIS Deputy Director for Policy Joseph Edlow. ....
